Terms of Service

Effective date: June 3, 2026

1. Agreement to Terms

By accessing or using Switchday ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. Switchday is operated by Jeffrey A Ver, a sole proprietor based in Chapel Hill, North Carolina. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Switchday is a co-parenting communication and record-keeping platform designed to help separated or divorced parents document shared custody arrangements, expenses, messages, and schedules. Features include tamper-evident messaging, shared custody calendars, expense tracking, and optional professional access for attorneys, mediators, and guardians ad litem.

3. Eligibility

You must be at least 18 years old to use Switchday. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into this agreement. Switchday is intended for use in the context of co-parenting and is not a substitute for legal advice.

4. Account Registration

You must create an account to use Switchday. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@switchday.app if you suspect unauthorized access.

5. Plans and Billing

Free Plan. Includes messaging (30-day history), custody calendar, children's profiles, and OFW import. No credit card required.

Family Pro Plan. $19.99/month per family unit, billed monthly. Covers both co-parents under one subscription. Includes full message history, expense tracking, Google Calendar sync, PDF export, SMS relay, and attorney portal access.

Billing is processed by Stripe. By subscribing, you authorize recurring charges. You may cancel at any time from Settings → Subscription; access continues through the end of the billing period. No refunds are issued for partial billing periods.

We reserve the right to change pricing with 30 days' notice to your registered email address.

6. Acceptable Use

You agree not to use Switchday to:

  • Harass, threaten, or harm any person
  • Submit false, fraudulent, or misleading information
  • Attempt to tamper with, alter, or forge records
  • Reverse engineer, scrape, or copy the Service
  • Violate any applicable local, state, or federal law
  • Use the Service for any purpose other than legitimate co-parenting communication and documentation

We reserve the right to suspend or terminate accounts that violate these terms without notice.

7. Records and Data Integrity

Switchday uses cryptographic hashing (SHA-256) and optional RFC 3161 trusted timestamps to create tamper-evident records of messages, expenses, and other communications. These records are designed to support documentation, but Switchday does not guarantee their admissibility in any legal proceeding. Admissibility is determined solely by the court or tribunal with jurisdiction over your matter.

RFC 3161 timestamping is provided by FreeTSA, an independent third-party service. Switchday makes no representations about FreeTSA's availability, accuracy, or reliability, and is not liable for any failure of that service.

You are solely responsible for consulting a licensed attorney in your jurisdiction regarding the use of any Switchday records as evidence. Switchday is a documentation tool, not a legal service, and nothing in the Service constitutes legal advice.

8. Professional Access

Family Pro subscribers may grant read-only access to licensed professionals (attorneys, mediators, guardians ad litem) via time-limited tokenized links. Switchday does not verify professional credentials. You are responsible for granting access only to authorized individuals and revoking access when appropriate.

9. Switchday Coach — Communication Guidance

Switchday includes automated communication coaching features ("Switchday Coach") that analyze message tone and suggest rewrites before sending. These features are powered by third-party services (currently OpenAI) and are provided for general communication guidance only.

Switchday Coach is not a licensed mental health service, legal advice, or a substitute for professional counsel. Automated suggestions may be inaccurate, incomplete, or inappropriate for your specific circumstances. You are solely responsible for the content of any message you choose to send, regardless of whether you used or modified a suggested rewrite.

By using Switchday Coach, you acknowledge that message content (excluding your identity) may be transmitted to third-party providers for processing. We do not use your message content for model training. See our Privacy Policy for details.

10. Children's Privacy

Switchday is not directed at children under 13. Profile information about children (names, ages, photos) is stored solely to facilitate co-parenting coordination and is never sold or shared with third parties, except as required by law or as explicitly authorized by you.

11. Intellectual Property

The Switchday name, logo, and all software are owned by Switchday. You retain ownership of any content you submit (messages, documents, photos). By submitting content, you grant us a limited license to store, display, and process it solely to provide the Service.

12. Account Closure

You may close your account at any time from Settings → Close Account. Closing your account cancels any active subscription and flags your account as closed. Your data is retained in our systems for a reasonable period consistent with legal obligations and is never permanently deleted. Closed accounts cannot access the Service.

13. SMS Relay

Family Pro subscribers may enable the SMS relay feature, which routes SMS communications through a Switchday-assigned phone number via Twilio. By enabling this feature, you consent to the logging and storage of SMS messages sent and received through the relay for record-keeping purposes. You are solely responsible for ensuring that any legally required consent has been obtained from all parties to the communication before enabling SMS relay. Wiretapping and electronic surveillance laws vary by jurisdiction. Switchday is not responsible for your compliance with applicable laws governing the interception or recording of communications.

Program name: Switchday SMS Relay

Message types: Co-parent message relay, one-time phone verification codes, and custody switch reminders. No marketing or promotional messages are sent.

Message frequency: Varies based on your co-parenting activity and settings. You will only receive messages when your co-parent sends a message, when a custody switch reminder is due, or when you initiate phone verification.

Rates: Message and data rates may apply.

Opt-out: Reply STOP to any Switchday SMS to opt out at any time, or disable SMS relay in Settings → Family → SMS Relay. After opting out, you will receive one confirmation message and no further messages will be sent.

Privacy: Your mobile phone number is used solely to provide this feature. We do not sell, rent, or share your mobile number or SMS opt-in data with third parties for marketing or promotional purposes. See our Privacy Policy for full details.

Carrier liability: Carriers are not liable for any delayed or undelivered messages.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR FITNESS FOR PURPOSE OF ANY AUTOMATICALLY GENERATED CONTENT, CRYPTOGRAPHIC RECORDS, OR TIMESTAMPS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWITCHDAY AND ITS OPERATORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR LEGAL STANDING, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO: (A) ANY RELIANCE ON TAMPER-EVIDENT RECORDS OR TIMESTAMPS; (B) ANY AUTOMATICALLY GENERATED COMMUNICATION SUGGESTIONS; (C) ANY FAILURE OF THIRD-PARTY SERVICES INCLUDING FREETSA, OPENAI, TWILIO, OR STRIPE; OR (D) ANY UNAUTHORIZED ACCESS TO YOUR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless Switchday and its operators, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit through the Service.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall first be submitted to good-faith mediation. If mediation fails, disputes shall be resolved exclusively in the state or federal courts located in Delaware. You waive any right to a jury trial for any claim arising under these Terms.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
